1. Acceptance of Terms

By downloading, installing, or using the ReadBorn application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. If you are a parent or guardian agreeing on behalf of a minor, you accept these Terms on their behalf.

2. Description of Service

ReadBorn is a children's literacy application that uses on-device voice recognition to help children learn to read by hatching illustrated creatures. The App is designed for children ages 5-12 and includes both free and premium content.

3. Eligibility

The App is intended for use by children under the supervision of a parent or guardian. Account creation and subscription management require a parent or guardian. Children under 13 may not create accounts without verifiable parental consent in compliance with COPPA.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use.

5. Subscriptions and Payments

The free tier provides access to one biome and a selection of creatures and stories at no cost.

ReadBorn Unlimited (Premium):

  • Monthly: $4.99/month
  • Annual: $39.99/year (approximately $3.33/month)
  • The monthly plan includes a 3-day free trial and the annual plan includes a 7-day free trial for new subscribers.

Billing:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
  • You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription.
  • Refund requests are handled by Apple in accordance with their App Store policies.

6. Intellectual Property

All content in the App, including but not limited to creatures, stories, artwork, animations, sounds, and text, is the property of ReadBorn and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission.

7. User Conduct

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the App.
  • Interfere with or disrupt the App or its servers.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App to collect information about other users.

8. Voice Recognition

The App uses on-device speech recognition provided by Apple's Speech framework. Audio data is processed locally on your device and is not transmitted to or stored on our servers. Microphone access is required for the reading experience and is requested with your explicit permission.

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, ReadBorn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
